The website offers products for sale to both users defined as “final consumers” and to subjects with a VAT number.
The images in the multimedia catalog, accompanying the technical specifications of the products, may not be perfectly representative of their characteristics.
The supply includes only what is specifically defined in the order confirmation; any other and different performance is considered and billed separately.
Acceptance of sales conditions and general terms
The contract concluded between CAD ITALIA SRL and the Customer is considered concluded with the acceptance of the order and the payment made by CAD ITALIA SRL. This acceptance is deemed tacit, if not otherwise communicated by any means to the Customer after CAD ITALIA SRL has verified the order. By placing an online order, you declare that you have read and fully accept the general sales and payment conditions transcribed below.
The customer must keep these general sales conditions (in compliance with the provisions of articles 50 et seq. of Legislative Decree no. 206/05) by printing a copy or saving it electronically.
Purchase procedure
The customer can purchase the products sold in the electronic catalog on the website www.fornidavid.it, as described in the respective informative technical sheets or in communications via email, also following contacts with CAD ITALIA SRL sales staff, who may send personalized quotes to the Customer, including sales prices, shipping prices, payment methods, articles in the delivery address order, and corresponding VAT.
Once payment is received from the Customer, CAD ITALIA SRL will initiate the phases related to the production/shipping of the goods.
Any notice of non-acceptance of the order due to product unavailability and/or longer delivery times than those indicated in the quote/product sheet will be promptly communicated to the customer, by phone or email. In such cases, the Customer may, alternatively, change the product, wait for availability within the new communicated times, or cancel the order requesting a refund for the amount already paid.
In all cases of changes in the buyer’s situation before delivery: incapacity, illness, bankruptcy, protested bills, suspension or delay of payments, etc., CAD ITALIA srl has the right to demand guarantees or cancel the sale as it stands: in this case, CAD ITALIA srl has the right to retain, as compensation, the sums received up to that moment, up to a maximum of 35% of the agreed amount. Until valid guarantees accepted by CAD ITALIA srl are received, the supply remains suspended.
If the Customer, before shipping the goods, intends to terminate the contract, or fails to fulfill their down payment commitment, CAD ITALIA srl may demand either the fulfillment of the contract or payment of 35% of the commission amount, as compensation for damages.
Any right of the Customer to compensation for damages is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order.
Any changes to already confirmed orders cannot be guaranteed and will be authorized by CAD ITALIA SRL based on the progress status of the production.
Shipments and deliveries
Purchases made on www.fornidavid.it are delivered via national couriers to the delivery address indicated at the time of ordering.
Delivery is considered completed for all legal purposes, at CAD ITALIA srl’s establishment upon notice of ready merchandise. The merchandise travels at the customer’s risk and peril, even if the sale is made “delivered duty paid”. CAD ITALIA srl does not consider itself in any way obliged to ship the merchandise via the carrier chosen by the customer. If the buyer, for any reason, delays the agreed delivery, this delay will not affect the payment terms established, whose deadlines will remain unchanged.
During the ordering process, CAD ITALIA SRL issues an appropriate accompanying document for the shipped material (Transport Document) while the invoice will be sent to the email address previously communicated by the Customer. The information provided by the Customer at the time of ordering is valid for the issuance of these documents. After the invoice has been issued, no changes to it will be possible.
The quote is non-binding and does not imply the conclusion of the order, except after confirmation of the order and transmission by CAD ITALIA SRL of the production orders to its suppliers.
The Customer can communicate any details they deem necessary for the courier to reach the delivery location, by indicating them in the order notes or through an email to info@fornidavid.it before the merchandise is shipped from the manufacturers’ warehouses.
It is therefore advisable to provide a telephone number where you can always be reached.
Any storage charges due to deliveries beyond the previously indicated terms (48 hours from the telephone notice) or due to repeated lack of response from the customer to the courier’s attempts to contact for delivery arrangements, will be entirely borne by the customer.
Standard delivery is made to the curb.
Couriers make deliveries from Monday to Friday, during normal working hours regulated and indicated by them and cannot be influenced by CAD ITALIA SRL.
No responsibility can be attributed to CAD ITALIA SRL for delays in delivery attributable to the assigned carrier.
Products are packaged with resistant materials suitable to ensure optimal protection during transport.
In the event of receiving goods that show obvious tampering and/or damage to the packaging, the customer must accept the goods with a “CONTROL RESERVE,” personally describing the damage in detail on all copies of the courier’s delivery receipts.
Once damage caused by transport is ascertained, the customer must report it to CAD ITALIA SRL within 5 (five) days of receiving the goods by email, complete with photographic documentation of the packaging and damaged goods.
The Customer who, for any reason, has not followed the aforementioned instructions of this contract cannot subsequently claim any shortages or damages caused by the carrier.
Delivery times
CAD ITALIA SRL undertakes to respect the times indicated in the quote, trying where possible to anticipate them.
The delivery times for delivering the goods to their destination are indicated in each quote but should not be considered binding on the Customer in relation to the conclusion of the contract entered into with CAD ITALIA SRL.
Delivery times can be checked at any time by the Customer with CAD ITALIA SRL operators by phone or email.
Any advances or delays in the delivery times indicated in the quote or provided via email or phone, not identifiable at the time of ordering, but only during the preparation or production phases, will be promptly communicated as soon as CAD ITALIA SRL becomes aware of them. In any case, they cannot be considered by the Customer for requests for damages compensation or indemnity as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property.
Payment methods
The prices shown in the product sheet of the items available for online ordering or quoted and the related shipping costs are always excluding VAT.
Following the purchase process, the customer can select the following payment methods:
a. Credit card: in cases of purchasing goods with credit card payment method, the charge to the credit card occurs simultaneously with the conclusion of the online transaction. CAD ITALIA SRL reserves the right to request additional information from the customer, such as identification documents and/or proof of ownership of the Credit Card used. In the absence of the requested documentation, CAD ITALIA SRL reserves the right not to accept the order.
b. PayPal: PayPal is one of the most widely used payment systems
in the world. By choosing this method, you can make the payment through your personal PayPal account simultaneously with the conclusion of the transaction.
c. SmallPay: You can spread your payment over convenient monthly installments with direct debit to your credit card. You only pay the monthly installment, without interest or other additional costs. The payment system is secure because it uses the NEXI payment gateway. At checkout, the active payment methods for the order will be presented. By selecting “SMALL PAY – PAYMENT IN INSTALLMENTS,” you will have the opportunity to enter the desired number of installments (with a minimum and maximum already calculated based on the order) and only after confirming the sales conditions can you enter the credit card details on which Small Pay will withdraw the monthly installment. Purchases cannot be made in installments with rechargeable cards.
Warranty
The products sold by CAD ITALIA SRL are covered by a warranty pursuant to Legislative Decree no. 206/05.
The warranty is valid for 12 months (for subjects with a VAT number) and for 24 months for subjects defined as final consumers. The warranty is considered from the delivery date and based on an estimated work equivalent to 8 hours per day. Normal wear and tear of the goods, items not produced by the supplier (thermostats – extractors, etc.), and the burner are excluded from the warranty. All electrical equipment is also excluded from the warranty.
Pursuant to Legislative Decree 206/05, the warranty applies to the product that presents a lack of conformity, provided that the product has been used correctly in accordance with its intended use. In case of lack of conformity, CAD ITALIA SRL will provide, at no cost to the Customer, the necessary spare parts to restore the conformity of the product. The labor costs necessary to restore the product will remain the responsibility of the end Customer.
The customer is required to check the goods and their operation within 5 days of delivery.
The customer is required to keep the original packaging and all additional documentation of the purchased products until the warranty period expires.
CAD ITALIA SRL does not guarantee damages caused by improper use of the item. The customer forfeits the right to warranty if the faults are caused by clumsiness, abnormal use, overload, poor maintenance, tampering, or modifications to the machinery not provided by the seller in writing and for damage attributable to force majeure.
If damage to the packaging is evident upon receipt of the goods:
EXPRESS A RESERVE: the package is accepted but before signing the document, the Customer must affix the wording “Accepted with reservation,” specifying as much as possible the damage found. Once the package is opened and the damage assessed, compensation for the damage suffered can be quickly obtained.
REJECT DAMAGED GOODS: if it is not possible to accept the package with a reservation or if the damage is visible without opening the package.
In any case, the Customer must report the damage within 3 days of delivery, documenting the damage with photographic material and description, communicating via email to info@fornidavid.it. Otherwise, CAD ITALIA SRL cannot be held responsible for any damage.
Assembly
The customer must, at their own expense, carry out all necessary work for assembly (plumbing and electrical installations, masonry, painting, etc.) within the term in which the items will be sent, as suggested in advance by CAD ITALIA srl. If these works are not yet completed upon the arrival of the items, CAD ITALIA srl is not obliged to carry out the assembly, which will be postponed. In this case, all expenses for work, parking, return trips of assemblers, and any warehousing costs, as well as transport and travel expenses for delayed supply and installation, are borne by the customer. Additionally, the customer will bear any increase in assembler pay due to nighttime or holiday overtime, travel expenses, and any accommodations for the assemblers.
Accessory expenses for assembly outside normal working hours at the customer’s request are borne by the customer. Assemblers will only receive orders from CAD ITALIA srl.
CAD ITALIA srl reserves the right to make during construction, assembly, and operation of the plant those modifications that appear appropriate for its best operation. Furthermore, the materials from installation onwards are the absolute property of CAD ITALIA srl, which, if it wishes, will arrange for their removal directly through its representatives. After fifteen days from the end of the installation of the plant, without the purchaser, by registered letter, having reported defects or imperfections, all the material is considered tested, without reservation on the part of the Purchaser.
If for any reason not attributable to CAD ITALIA srl, it is not possible to carry out the testing of the plant after assembly, the customer will bear the expenses for the meals, accommodation, and subsequent travel of the assemblers. As well as the cost of the assembler himself at ANIMA rates.
Right of withdrawal
In the case of a final consumer customer, the right of withdrawal can be exercised in accordance with articles 64 et seq. of Legislative Decree no. 206/05.
To exercise this right, the Customer must, within 14 days from the date of receipt of the goods, send a communication to CAD ITALIA SRL by registered letter with return receipt in advance via email to the address info@fornidavid.it, declaring their intention to exercise the right of withdrawal and indicating the order number, invoice number, code and quantity of the items, whether the withdrawal is partial (only in case of purchase of multiple items) or total, and the bank details to obtain the refund (IBAN code of the invoice holder).
The goods must be returned intact (i.e., never used) in the original packaging properly sealed, complete in all its parts (including packaging, internal protections, external protection, wooden pallets, and any accompanying documentation and accessory equipment: manuals, assembly equipment, etc.) to CAD ITALIA SRL through a courier appointed by the Customer.
The shipping costs related to the return of the goods are borne by the Customer.
CAD ITALIA SRL, after verifying the integrity of the goods, will proceed within 14 days from the return to credit the value of the product(s) while retaining only the amount of the shipping costs, additional services, and any cash on delivery fees incurred for the delivery of the goods to the Customer and indicated on the accompanying invoice.
The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the product.
The shipment for the return of the material, until the attestation of receipt in our warehouse, is under the complete responsibility of the Customer.
In the event of damage to the goods during the return transport, CAD ITALIA SRL will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow them to promptly report it to the courier they chose and obtain reimbursement for the value of the goods (if insured); in this case, the product will be made available to the customer for its return and simultaneously cancel the withdrawal request and therefore the refund
CAD ITALIA SRL in no way is responsible for damage or theft/loss of goods returned with shipments not insured by the Customer.
Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the original packaging and/or packaging is excessively damaged, CAD ITALIA SRL will withhold from the due refund the expenses incurred for their restoration.
The right of withdrawal is completely forfeited if the essential condition of integrity of the good is lacking, in cases where CAD ITALIA SRL verifies:
a. careless use of the good that has compromised its integrity or the use of any consumables;
b. the absence of the external packaging and/or original internal packaging;
c. the absence of integral elements of the product (accessories, screws, etc…);
d. damage to the product due to causes other than its transport.
In the event of forfeiture of the right of withdrawal, the goods will remain at the CAD ITALIA SRL headquarters for the Customer to collect at their own expense.
The right of withdrawal CANNOT be exercised in the case of purchases of custom products according to the specifications requested by the Customer and for which finishes of colors or writings chosen or sent by the Customer have been made.
